Terms and Conditions

This Agreement (“Agreement”) is entered into on [Date], by and between Shoot With Dwayne LLC (“Photographer”) and [Client’s Full Name / Business Name] (“Client”)

Services

Photographer agrees to provide photography services as outlined in the agreed-upon proposal or invoice (“Services”). Services may include, but are not limited to, pre-shoot consultation, photography coverage, editing, and delivery of digital images

Booking & Payment

A non-refundable deposit of $50 is required to secure your session date.
The remaining balance is due no later than day of the session.
Payment may be made via Zelle, Venmo, or Cash

Cancellations & Rescheduling

Deposits are non-refundable under any circumstances.
Rescheduling is permitted once with at least 72 hours notice, subject to Photographer’s availability.
Cancellations with less than 72 hours notice may forfeit all fees paid.
In the event the Photographer must cancel due to illness, emergency, or unforeseeable circumstances, all money paid will be refunded or rescheduled at the Client’s discretion

Image Delivery

Edited digital images will be delivered via an online gallery within two weeks of the session.
The number of images delivered will be at Photographer’s discretion based on quality and session type.

Session Duration and Extended Services

Most photography sessions are designed to last between 30 minutes to 1 hour, depending on the service type and scope.
If additional time is needed beyond the standard session, extended shoot durations can be arranged in advance.
Any session requiring more than 1 hour may be subject to additional fees, which will be discussed and agreed upon prior to the shoot.

Copyright & Image Use

Photographer retains full copyright to all images.
The Client receives a non-exclusive, non-transferable license to use the delivered images for personal or business use.
Commercial use, resale, or third-party editing beyond basic cropping or filters is not permitted without written consent.

Model Release

Unless otherwise agreed in writing, Client grants Photographer permission to use images for promotional purposes, including but not limited to website, portfolio, social media, and marketing materials.

Limitation of Liability

Photographer is not liable for events beyond their control (e.g., weather, illness, equipment failure).
In the rare event Photographer cannot fulfill services, liability is limited to rescheduling or a refund of fees paid.

Client Cooperation

Client agrees to arrive on time and be prepared for the session.
Late arrivals may result in reduced shooting time with no refund or credit.

Artistic Style & Edits

Client acknowledges familiarity with Photographer’s portfolio and editing style.
Photographer retains discretion over image selection and editing; raw/unedited images will not be provided.
